[Guardianship and guardianship council] Abstract The topic of this thesis is guardianship and the guardianship council. The aim of the thesis is to examine the legal regulation of guardianship and guardianship councils in the past and also to examine the current legal regulation. This thesis should provide information on where we place guardianship and the guardianship council and what their purpose is and how they function. In this thesis, the Czech legislation on guardianship is partly compared with the French legislation. The first chapter deals with the family and parental responsibility. The rights and obligations that are the content of parental responsibility, who is the bearer and the executor of parental responsibility are listed and defined. And what protective measures exist when a parent does not exercise parental responsibility. The second chapter of this thesis is devoted to a historical excursion from the times of the Roman Empire to the Family Law, describing how guardianship worked and to whom a guardian was appointed at each stage. Roman law provided an important basis for the development of private law, and the law of guardianship was no exception. Later legislation was inspired by Roman law. Sharing pictures of children by their parents on social media

This theoretical based bachelors theses is focused on phenomenon of sharing pictures of children online by their parents, so called sharenting (especially on Facebook or Instagram). There are risks connected to this kind of sharing, such as formation of a digital footprint, which could include sensitive information, details from personal life or other problematic information, which would never be shared by children it concerns. This work attempts to capture the consequences this sharing could have for a life of a child outside of online world as well as for their online presence. All these phenomena will be described in theory but also by a legal perspective. Considering the terms and conditions of use published by META or other legal documents, this work attempts to answer following questions: To what extend is sharing this information unsafe? Can the child seek legal defence? And what legal boundaries are there for this kind of sharing? By analysing and interpreting academic and other relevant texts, together with legislation and jurisdiction, this work presents a conclusion, that such sharing could be a violation of privacy of a child, which would go hand in hand with violation of obligatory care for the child deriving from parental responsibility. Parental responsibility and netolism.

The thesis deals with netolism and other risky behavior of children and adolescents on the Internet, points out the fundamental role of parents in this issue. It introduces the concepts of dependence, the family and parental responsibility. Attention is paid to addiction to social networking sites and online games and some other types of risky behavior on the Internet, e.g. cyberbullying, sexting, cybergrooming. The impact of excessive internet use on the development of children and adolescents is considered. The theoretical findings are supplemented by the view of social worker's of the Authority for Social and Legal Protection of Children and a non-substance addiction prevention worker of the Pilsen Region which was obtained by conducting semi-structured interviews.
Exercise of parental responsibility

This bachelor's thesis deals with the execution of parental responsibility and mainly the description of the Cochem model, which is closely related to this execution. It aims to describe and analyse the execution of parental responsibility and details related to this issue. Above all, describe the basic relationships between parents and children in connection with the execution of parental responsibility, parental responsibility as such and possible resolution of conflicts, which includes a description of the Cochem practice. The thesis is divided into two parts, namely the theoretical and practical parts. The theoretical part consists of the definition of basic concepts that relate to the issue of parental responsibility. The next chapter consists of a description of parental responsibility to the child and discusses its implementation in cases where parents live together and not. Furthermore, the theoretical part deals with the resolution of parental conflicts in court and out of court. The final part of the theoretic definition concerns the Cochem method, mainly the official German definition, and next, the description of this practice in the Czech Republic. There is a comparison of both applications of Cochem practice. Furthermore, the work provides an insight into the pros and cons of the issue and the results in possible proposals and measures to improve the model in the Czech Republic. The practical part of the work focused on summarizing and evaluating information concerning the use of Cochem practice obtained from a questionnaire survey of Department of Social and Legal Protection of Children employees. This information is further analysed and provides answers to the research questions which are discussed at the end.
Development and Support of Parental Competencies in Working with Vulnerable Families

This diploma thesis is focused on the issue of parental competence in vulnerable families. It offers an insight into social work with families where biological, psychological or social development of children can be threatened. Parental competence is related to fulfilling functions of family and satisfaction of needs of all family members. The aim of this work is to describe how social workers support and develop parental competence when working with vulnerable families and children. In accordance with the aim of the work, the author defined two research questions which focus on how social workers approach and influence parental competence of their clients. In her research, the author used qualitative approach which provided deeper understanding of social workers' intervention in vulnerable families. The research involved survey and semi-controlled interviews. To assessed the collected data, the method of data classification was used. The analysis of the obtained data has shown that it is essential to develop principals of family support which are reflected in the relationship between social workers and families. Only then support can be provided. Social workers should strive to build trust, approach families with respect, empathy, authenticity, without prejudice and in certain cases with sufficient authority. In their interactions with families, social workers should act as partners, motivate clients towards change and promote interdisciplinary collaboration. To develop and support parental competence, it is important to create a support system and define desired patterns of collaboration. Social workers should provide not only information but also support, help, and alternative perspective on the situation to empower their clients. That can be achieved by accompanying families, providing practical training, mediating contact with social environment, providing professional assistance etc. This should be done so that client's will to learn and change their behaviour leads to successful acquisition of parental competence. Findings of this work can serve as a feedback for social workers.
Cochem Practice in the Childcare System

The work is focused on the topic "Cochem practice in the child care system", ie. to the system of adjustment of care and nutrition for minors and the use of elements of one of the approaches. The aim of this work is to find out what are the differences between Cochem practice and the current system of decision-making on child care. In the diploma thesis, we first focused on the institute of family, parenthood and rights and obligations. In the event of a parental conflict, who and how is involved in it, which entities are involved in resolving it or may be involved. We approached the possibilities of an amicable solution and focused in more detail on the Cochem practice, where we compared this approach with a model common in our country and legally based. Cochem practice is based on four basic principles. It is about resolving a dispute between parents as quickly as possible, maintaining parental responsibility for the child for both parents, preferences for parental agreement, if necessary with the help of experts within a multidisciplinary team. We have chosen a qualitative form of research to meet the goals. For the purposes of the research, the method of semi-structured interview was chosen. First, a preliminary research was carried out, then the research itself was carried out. To supplement, we used content analysis of the data. The research sample was selected by the Snow-ball method. and in its final form numbered 13 communication partners. Based on the evaluation of data obtained from the research, we can state that certain differences can be seen between the compared groups. Within the framework of Cochem practice, specific terms of some steps concerning the course of proceedings are elaborated in more and more detail, as well as the competences of individual actors within the framework of cooperation in a multidisciplinary team. The key is speed of proceedings to avoid unnecessary escalation of the dispute and escalation of accompanying problems. Parents are led to re-assume parental responsibility. In contrast, in the second group, the individual professions do not cooperate intensively or closely, the proceedings on the regulation of education and care for minors take a relatively long time, decisions are much more often made authoritatively. It is therefore possible to state that the aim of the work was fulfilled and the research question was answered.

Adjustment of child circumstances after the divorce Abstract This diploma thesis focuses on the adjustment of circumstances of children of divorced parents. Structurally, the thesis is segmented into an introduction, 6 chapters and conclusion. In case of content the thesis can be divided into four pivotal categories. The first part provides a general view into the elemental problems of parental liability. The second part focuses on the problem of the adjustment of circumstances of children after the divorce of their parents as such and examines all attributes in detail that the adjustment approaches. Great attention is given to the types of childcare, child-support and the contact of the non-resident parent with the child. The topic of the third part is the analysis of reasons that can be the cause of change of the present conditions. Finally, the fourth section provides a comparison of the current Czech legislation with the one of the Netherlands. Parental responsibility and its exercise The aim of my final thesis is to analyze parental responsibility and its exercise in the Czech rule of law by the Czech's principle. These thesis contain chapters about historical trends of family law, children rights and development of mutual law and duties of parents and children from the past to present. Some space is also devoted for government interference into parental responsibility. The reason why I chose the theme of parental responsibility for my final thesis is its current status which can be involved for everyone. Final thesis is divided into seven chapters. First chapter contains two parts. The first part is describing family law and explaining its position in a general law and its subject and principle. The family is a term, which is known in each period of history of mankind. It played, playes and will play an important role in life of every individual. It helps to create an identity of individual, a scale of values and principles, which are so necessary for happy life. The topic of my thesis is Rights and Obligations of Parents and Children with Emphasis on Selected Issues of Development of Relationship between Parents and Children. I have chosen this topic because I think that this part of family law is very interesting, especially the questions regarding to the determination of parenthood in the time of the medical breakthroughs. The purpose of my thesis is to analyse Czech legislation with regard to international law.
